Former Nebraska Congressman Jeff Fortenberry was back in a California court room Tuesday as the 9th US Circuit Court of Appeals heard his claims. The appeal alledges that he unfairly faced a jury in bright-blue California, rather than in his really-red home state, or in Washington, D.C., where the statements were made.
The Nebraska Examiner reports the 3-judge panel heard 38-minutes of arguments. 2 of the judges are Biden appointees and the third was a 2014 appointee of President Barack Obama.
